1. RiseUp: The service provided by RiseUp, including both hard and soft buttons.
2. User: Any individual or entity using the services of RiseUp.
3. Service: The notification system provided by RiseUp, informing recipients of potential referrals, helping identify such opportunities, increasing awareness and engagement, and all other activities as broadly as can be defined surrounding such services (collectively, “Services”).
4. Notifications: Alerts sent via text and email to inform recipients of potential referrals.

Use of Service

1. Eligibility: To use RiseUp, you must be a registered healthcare provider or an authorized representative.
2. Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
3. Prohibited Uses: Users agree not to use the service for any unlawful purpose or in a way that violates these terms.

Service Description

RiseUp provides a notification system using IoT (hard) and virtual (soft) buttons to alert recipients of potential referrals. No Protected Health Information (PHI) is exchanged through this service.

Intellectual Property

All content, trademarks, service marks, and logos included on our website are the property of RiseUp or its licensors. Users are not permitted to reproduce, distribute, or otherwise use these materials without prior written consent.

Limitation of Liability

RiseUp will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including, but not limited to, reliance on any information obtained through the service or that result from mistakes, omissions, interruptions, deletion of files, or any failure of performance. To the extent permitted by applicable law, the aggregate liability of each of us, our affiliates, officers, employees, agents, suppliers, and licensors arising out of or in connection with the services and these terms will not exceed the amount you paid to us for use of the services at issue during the 12 months prior to the event giving rise to the liability.

Users agree to indemnify and hold harmless RiseUp and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the user's breach of these terms, or violation of any law or the rights of a third party.

RiseUp reserves the right to modify these terms at any time. Users will be notified of any changes, and continued use of the service after such modifications will constitute the user's acknowledgment of the modified terms and agreement to abide by them.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which RiseUp operates, without regard to its conflict of law principles.

Refund Policy

Please be aware that all subscription fees or any other charges of any kind are non-refundable. Once a subscription payment is processed, it cannot be reversed or refunded under any circumstances. We encourage our subscribers/users to carefully consider their commitment to our program before making a purchase.

Cancellation

We offer the flexibility to cancel your subscription at any time. You are not bound by any long-term contracts, and there are no cancellation fees. To cancel your subscription, simply reach out to info@rise-up.com. Once canceled, your subscription will remain active until the end of the current billing cycle, after which you will no longer be charged.
